The Administrator will conduct the Sweepstakes as described in these rules. By participating, each participant agrees as follows

Description of Sweepstakes/Participation.

DATES OF SWEEPSTAKES

The Sweepstakes will begin at 12:00 p.m. on June 12, 2009 and will end at 11:59 p.m. on September 12, 2009 ("Sweepstakes Period"). All times referred to in these Official Rules are Central Time.

HOW TO ENTER

No purchase necessary. Void where prohibited. Entrants and Winners must be 18 years of age or older with valid driver’s license. Odds of winning depend on number of entries received and number of Green Days forecast by the Illinois Environmental Protection Agency (“the Agency”). Odds of winning a prize will decrease for entrants as Sweepstakes approaches its end date.

One entry per person per day regardless of method of entry. Sweepstakes entries are checked regularly to ensure that entrants are not violating this rule. In the event an entrant is found to have submitted more than one entry on any given day during the Sweepstakes, the Administrator will disqualify any and all entries submitted by that entrant for the entire 2009 Green Pays on Green Days Sweepstakes. The Administrator reserves the right to disqualify entries for the violation mentioned above without any obligation to notify the entrants of their disqualification.

Incomplete entries will be disqualified.

There are three ways to enter the Sweepstakes:

  1. To enter online, log onto http://www.greenpays.org, or find a link to the sweepstakes on http://www.nbc5.com or http://www.telemundochicago.com. Click on the sweepstakes link and complete the Internet entry form, which will ask for your name, address, county of residence, daytime phone number, and email address. Only one email address per individual may be used throughout the Sweepstakes Period; entrants using multiple email addresses risk disqualification of all entries submitted under the entrant’s name. The entry form will ask you to verify that you are at least 18 years of age. The entry form will ask you to choose one thing you can do to fight air pollution in the greater Chicagoland area. The entry form will ask you to indicate where you learned about the sweepstakes. The entry form will also allow you to mark checkboxes to receive additional information (e.g., to indicate that you wish to receive Sweepstakes reminders via email). To unsubscribe to the email list, send an email to the following address: EPA.Partners@illinois.gov. All online entries must be received before 11:59 p.m. on September 12, 2009 to be eligible for the Sweepstakes.
  2. To enter by mail without an official “Green Pays on Green Days” entry card, print your name, complete mailing address, county of residence, daytime phone number and year of birth on a 3x5 card, place it in an envelope, and mail it via first-class mail to Green Pays On Green Days, c/o Illinois EPA, 1021 North Grand Avenue East, #35, Springfield, IL 62702. All mail-in entries must be hand-printed and legible. Mailed entries must be postmarked no earlier than June 12, 2009 and no later than September 12, 2009 and received no later than the close of business on September 18, 2009 to be eligible for the Sweepstakes. PLEASE NOTE: All eligible entries, including those received via U.S. mail, are added to an electronic database. Mail-in entries will be entered by the date they are postmarked. Only one entry per person per day regardless of method of entry will be permitted. Winners are randomly selected from this electronic database. Entering by mail will in no way increase the chances of winning.
  3. To enter on-site, you may complete an official "Green Pays on Green Days" entry form at various special events throughout the Sweepstakes Period. Sweepstakes representatives will be available on-site at select special events to accept completed entry forms. Dates and events at which entry forms will be available are subject to change at Administrator’s sole discretion. Administrator is not liable if entry forms are not available on a given day at a given event. To find out about current events go to www.cleantheair.org/calendar.html. Individuals may complete the entry form on site, which will be collected as an official entry by the Sweepstakes sponsors or individuals may mail the entry to Green Pays on Green Days, c/o Illinois EPA, 1021 North Grand Avenue East, #35, Springfield, IL 62702. All mail-in entries must be hand-printed and legible. Mailed entries must be postmarked no later than September 12, 2009 and received no later than the close of business on September 18, 2009 to be eligible for the Sweepstakes.

HOW WINNERS ARE SELECTED

“Green Day” Prize Winners: The Agency - based on the weather forecast and the actual air pollution monitoring data - issues an air quality forecast at about 4 p.m. each weekday. This forecast may indicate that the following day is expected to be a good air quality day (i.e., a "Green Day"). Every day throughout the Sweepstakes when a “Green Day” is designated by the Agency, a minimum of one (1) winner will be randomly selected by the Administrator from all eligible entries received to date. Because this designation is tied to the weather and the air quality forecast, there is no way to accurately estimate how many Green Days there will be over the course of the Sweepstakes Period. The person(s) selected will win a Green Day Prize. The Agency will contact the winner(s) based on information provided on the entry form; the Green Day Prize(s) will be sent via United Parcel Service or United States Postal Service to the address provided by the winner(s). If the Agency is unable to contact winner(s) from the information provided after a reasonable effort has been made, it reserves the right to select another winner(s) at its sole discretion.

Only one (1) Green Day Prize per household for the duration of the Sweepstakes.

Grand Prize Winner: On the evening of September 29, 2009 at the Peggy Notebaert Nature Museum (2430 N. Cannon Drive, Chicago IL, 60614), one (1) entry will be randomly selected from among the eligible Green Day Prize Winners (as defined below) to win the Grand Prize. The eligible Green Day Prize Winner or a proxy must be present to win the Grand Prize. The Grand Prize drawing is part of a Sweepstakes closing reception, which begins at approximately 5:30 p.m. and ends at approximately 8:00 p.m. on September 29, 2009.

ELIGIBILITY AND OTHER LIMITATIONS

Entrants must be 18 years or older at time of entry. Entrants must be a legal U.S. resident of one of the following Illinois counties: Cook, DuPage, Lake, Will, Grundy, Kane, McHenry, or Kendall.

Grand Prize Winner must possess a valid Illinois driver's license and show proof of automobile insurance coverage as required by state law prior to taking possession of the Grand Prize.

Employees of the American Lung Association of Illinois, NBC Universal, Inc., WMAQ-TV/NBC5, Telemundo, Clear Channel Radio, Next Media, Toyota Motor Sales USA, Inc. (“TMS”), Chicagoland/Northwest Indiana Toyota Dealers (“the Grand Prize Donor”), the Illinois Environmental Protection Agency and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

PRIZES

The prize(s) that will be awarded to the eligible winner(s) are:

Green Day Prize:
Every day throughout the Sweepstakes when a Green Day is designated by the Agency, a minimum of one (1) winner will be randomly selected from all eligible entries received to date. The person(s) selected will win a Green Day Prize, which will be delivered to the address listed on the entry form. The Green Day Prize features environmentally friendly product(s) for the home including items like compact fluorescent light bulbs, reusable grocery bags, and more. List of prizes is for illustrative purposes only; winners may receive different prizes to be chosen by Administrator in its sole discretion. The approximate retail value of each Green Day Prize is $75.

Grand Prize:
A 2009 Toyota Prius hybrid (estimated Base MSRP of the 2009MY Toyota Prius hybrid is approximately Twenty-Two Thousand U.S. Dollars ($22,000.00)) selected by Chicagoland/Northwest Indiana Toyota Dealers and/or the Grand Prize Donor, in their sole discretion. All details of the Grand Prize to be determined by Chicagoland/Northwest Indiana Toyota Dealers and/or the Grand Prize Donor. The depiction of the Grand Prize vehicle in any advertising or promotional materials may not reflect the actual vehicle delivered to the winner. In order to accept the Vehicle, Grand Prize Winner must possess and present adequate personal identification, evidence of legally required insurance, and a valid Illinois driver’s license. Grand Prize Winner bears the risk of damage to Vehicle after delivery to specified Delivery Site and Vehicle will be forfeited if not picked up within thirty (30) days after delivery thereto. Vehicle shown may not be actual Vehicle delivered. All reasonable efforts shall be used to provide the same model and year as shown or at least a Vehicle having substantially the same dealer cost. Grand Prize Winner is solely responsible for all travel and transportation costs incurred in connection with collecting Vehicle, as well as any insurance, Grand Prize Winner requested additional options, if allowed by Grand Prize Donor, and any other costs incurred in claiming, registering, or using the Vehicle, including, without limitation, any costs incurred in bringing the Vehicle from the Delivery Site to the Grand Prize Winner’s home and any other costs/expenses not specifically mentioned as being included. Grand Prize Winner will pay all applicable state and local sales tax, and title, license and initial registration fees. Vehicle will be delivered solely with the express written limited warranties set forth in the applicable Warranty Booklet. Grand Prize Winner is not eligible for any cash rebate programs. Interior and exterior colors of the Vehicle will be determined by Sponsors in their sole discretion. Grand Prize Winner agrees that Sponsors and Sweepstakes Entities have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Vehicle, including, but not limited to, the quality, mechanical condition, or fitness, except that Vehicle does include Toyota’s standard new vehicle limited warranty as set forth in the Vehicle’s Warranty All federal, state, or other taxes, including, without limitation, income taxes, are the sole responsibility of Grand Prize Winner.

The Grand Prize Winner will be chosen in a live Grand Prize Drawing at the Sweepstake’s closing event from among the Green Day Prize Winners. The drawing will take place on Tuesday, September 29, 2009 at the Peggy Notebaert Nature Museum (2430 N. Cannon Drive, Chicago IL, 60614). Winner or proxy must be present in order to win the Grand Prize. The Grand Prize drawing is part of a Sweepstakes closing reception, which begins at approximately 5:30 p.m. and ends at approximately 8:00 p.m. on September 29, 2009. Note: If a Green Day Prize Winner cannot attend the closing event, the Winner may designate a proxy as a representative at the Grand Prize Drawing by completing a Green Pays on Green Days Affidavit Letter provided by the Agency.

If a Winner is disqualified, the Administrator reserves the right to select an alternate winner. For all prizes, the Administrator reserves the right to award a prize of equal or greater value.

DELIVERY DISCLAIMER

The Administrator, the Sponsors, and the Entities disclaim all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Mail-in entries must be handwritten and legible. No photocopies or mechanical reproductions of entry forms are permitted. The Administrator is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any Web site, or lost or unavailable network connections which may limit an online entrant's ability to participate in the Sweepstakes, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes.

INTERNET DISCLAIMER

If the Internet portion of the program is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Administrator which corrupts or affects the administration, security, fairness, or integrity of the Sweepstakes, the Administrator reserves the right in its sole discretion to disqualify any individual believed to have tampered with the entry process, and/or to cancel, terminate, modify or suspend the Sweepstakes. The Administrator assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Administrator is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or provider, computer equipment, software, failure of any email to be received by the Administrator on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to the entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes. The use of automated entry devices is prohibited. CAUTION: ANY ATTEMPT TO DELIBERATELY TAMPER WITH THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY OFFENDER TO THE FULL EXTENT PERMITTED BY LAW.

In the event of a dispute over the identity of an online entrant, the entry will be deemed to have been submitted by the authorized holder of the email account from which the entry is made. The "authorized account holder" is the natural person to whom an email address is assigned by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) responsible for assigning email addresses for the domain associated with the submitted email address.

PUBLICITY; USE OF PERSONAL INFORMATION

By participating in the Sweepstakes, all entrants and winner(s) grant the Agency, the Sponsors, the Entities, and their respective advertising and promotional agencies exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other sweepstakes and for advertising and promotional purposes without any additional compensation being provided and waive any claims to royalty, right, or remuneration for such use. Acceptance of a prize constitutes permission for the Agency, the Sponsors, and the Entities and/or their designees to use the winner’s name, address, photograph, testimonial or other likeness and/or prize information or personal exposition (and/or any edited portion thereof) for promotional, advertising and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity, without compensation or notice to, or further consent of, to the winner to the extent permitted by law.

RELEASE

By participating in the Sweepstakes, each participant and winner waives any and all claims of liability against the Administrator and its employees and agents, the Agency and its employees and agents, the Sweepstakes’ Sponsors and their respective employees, agents and advertising or promotional agencies, and the Entities and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Sweepstakes, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Agency. The Administrator, the Agency, the Sponsors, the Entities, and their respective advertising and promotional agencies shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the prizes provided pursuant to the Sweepstakes and/or any person’s participation in the Sweepstakes; provided, however, that Toyota Motor Sales USA, Inc. shall be solely responsible for any express written limited warranties specifically set forth in the applicable Owner's Guide for the Grand Prize Vehicle. Chicagoland/Northwest Indiana Toyota Dealers shall not be responsible for delays in delivery of the Grand Prize Vehicle, and delivery is subject to availability. Chicagoland/Northwest Indiana Toyota Dealers, however, shall use all reasonable efforts, subject to availability, to deliver the Grand Prize Vehicle within one hundred twenty (120) days after receipt of the aforementioned items/information. The winner shall bear all risk of loss or damage to the Grand Prize Vehicle after it has been delivered to the specified delivery site. The winner must personally retrieve the Grand Prize Vehicle within thirty (30) days of written notification of delivery and must present adequate personal identification and evidence of legally required insurance (or an alternative winner shall be selected and the original winner’s rights to the Grand Prize Vehicle shall be automatically forfeited).

TAXES

Any valuation of the prize(s) stated above is based on available information provided to the Administrator. The value of any prize awarded to a winner must be reported for tax purposes, as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prizes which are not specifically provided for in the official rules. The Grand Prize winner must provide the Agency with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. The winner shall be responsible for all taxes, license, title and registration fees or other costs, including without limitation any travel or transportation costs associated with transferring, delivering and/or winning of the Grand Prize Vehicle (provided, however, the Grand Prize Vehicle shall be delivered at no cost to the winner at an authorized Toyota/Lexus/Scion dealer or distributor in the continental U.S. reasonably close in proximity to the winner's residence). Prizes are not transferable, redeemable for cash, exchangeable for any other prize and there are no substitutions on any prizes except that the Administrator and Sponsors reserve the right to substitute prizes of equal or greater value. Any person winning over $600 in prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

DECISIONS

By participating in the Sweepstakes, participants agree to be bound by the decisions of the Administrator’s employees and agents, who will serve as judges and select winners. The Administrator reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who the Administrator believes has violated any rule, gained unfair advantage in participating in the Sweepstakes, or obtained winner status using fraudulent means. The Administrator will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules of the Sweepstakes and the Administrator's decisions concerning such disputes shall be final. If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Administrator, the Administrator reserves the right to terminate this Sweepstakes, or make such other decisions regarding the outcome as the Administrator deems appropriate.

All decisions made by the Administrator are final. The Administrator may waive any of these rules in its sole discretion.

MISCELLANEOUS

Each winner must submit proof of eligibility and sign the Sweepstakes’ release form to claim the prize. Odds of winning depend upon the number of participants and the number of days when a “Green Day” is designated by the Agency. The Administrator may substitute prizes or discontinue the Sweepstakes at any time. The Administrator disclaims any responsibility to notify participants of any aspect related to the conduct of the Sweepstakes. Written copies of these rules are available during normal business hours at the business offices of the Administrator and by mail upon written request with a stamped, self-addressed return envelope.

For the names of the winners, available on or after October 8, 2009, send a stamped, self-addressed envelope to Green Pays on Green Days Winners List, c/o Illinois EPA, 1021 North Grand Avenue East, #35, Springfield, IL 62702. All entries become the property of Administrator and will not be returned.

COMPLIANCE WITH LAW

The conduct of the Sweepstakes is governed by the applicable laws of the state of Illinois, which take precedence over any rule or law to the contrary herein.
